Important Notice
Porchlight is a wellness and informational product, NOT a medical device. It is not FDA cleared or approved. Porchlight makes no diagnoses, offers no treatment recommendations, and makes no medical judgments of any kind.
Trend indicators and status labels ("Steady", "Worth a look", "Calibrating") are algorithmic estimates derived from consumer wearable data (primarily Apple Watch HealthKit metrics). Consumer wearable data can be incomplete, inaccurate, or affected by many factors including watch fit, wear time, sensor limitations, and individual physiology. False positives and false negatives will occur.
- A "Steady" status is not an assurance of good health.
- The absence of an alert is not an assurance that nothing is wrong.
- Porchlight does not detect falls, emergencies, or acute medical events.
Porchlight is not an emergency service. It must never be relied upon in place of emergency services (call 911 or local equivalent), medical alert systems, professional medical care, or regular personal contact with family members.
Assumption of Risk & Limitation of Liability
By using Porchlight, you acknowledge and agree that:
1. You assume all risk associated with reliance on the information, trends, digests, alerts, or reports provided by the app.
2. You will always consult a qualified healthcare provider before making any health decisions or taking any action based on app output.
3. To the maximum extent permitted by applicable law, [COMPANY LEGAL NAME] and its officers, directors, employees, and agents shall not be liable for any decisions made or not made based on app information, for any missed or delayed alerts, for any inaccuracies in data or trends, or for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.
4. Family sharing features are provided for awareness and connection only. Shared data is a summary for informational purposes. Family members agree not to treat Porchlight as a substitute for direct care, regular check-ins, or professional medical advice.
Not a Medical Device — Regulatory Positioning
Porchlight is designed and marketed strictly as a wellness and informational tool to help families stay connected to the general well-being trends of aging loved ones who already wear an Apple Watch. It does not:
- Diagnose, treat, cure, or prevent any disease or medical condition
- Monitor for specific clinical events (e.g., arrhythmias, hypertension, falls)
- Provide medical alerts or emergency notifications
- Replace any prescribed medical device or professional monitoring
If you experience any health concerns, contact your doctor or emergency services immediately. Do not wait for or rely on Porchlight.
Placement of Condensed Disclaimer
The following one-line statement (or substantially similar language) must appear on:
- Onboarding screens
- Every weekly digest
- Every family alert
- Every doctor-ready PDF report
- Website footer
> Porchlight is a wellness app, not a medical device — always talk to a doctor about health concerns.
This page is linked from that statement.
Acknowledgment
During onboarding, users must explicitly accept this Wellness Disclaimer (along with the Terms of Service) and the acceptance timestamp + version shall be recorded.
This is a draft document prepared to save attorney review time. It does not constitute legal advice and is not yet in effect. All language is subject to attorney modification for enforceability under [STATE] law and compliance with applicable federal regulations (including but not limited to FDA guidance on wellness devices and App Store Review Guidelines).
